You can't explain their standing for the lawsuit, and we both know it, and that's why you're not even going to attempt it.

When a person is incarcerated, the state is responsible for their care until they are released, including physical safety. These women were impregnated by a fertile male in a woman's prison. That is cause for a lawsuit.

Putting aside that, as stated in the article you claimed you read, the sex was consensual in both cases, none of this explains the standing the families have to sue, as you claimed they would.

The families have been damaged by the acts of a male inmate in a woman's prison. They have the right to be made whole. The man who impregnated the women is not likely capable of doing so, so it falls upon the state of New Jersey to do so.

Simply saying they have been damaged in no way explains how they have been damaged. How does a prisoner getting pregnant through consensual sex damage someone related to them?

The point is that the state of New Jersey housed a fertile biological male in a women's prison. Consent has absolutely nothing to do with the families' being damaged, and therefore, having cause to sue the state for these damages.
Inmates are being cared for by the states in which they are imprisoned. New Jersey failed to protect these women from this man.
