It’s the legal authority Trump used to turn COVID into a denial of entry. The CDC is allowed to use the threat of a communicable disease to not even ask someone why they’re coming or what the situation is before they try and enter. So they just get to plug their ears and reject anyone and everyone. I don’t even think they have to give them a test or say “get vaccinated” or ask if they are vaccinated. They just get to skip directly to no.
I agree. He lacks legal standing to file this appeal, unless I miss my guess here.
My point is that a sitting judge ruled in a case. The way to get the ruling overturned is to appeal it to a higher court (have you been hacked? A law student should know this). You don't just throw a ruling out because you don't like it. There has to be a legal reason to do so.
All the hubbub is rather ridiculous since the same day this judge made this ruling, the mandates were set to expire, and the CDC was only going to extend them for like, another two weeks.

Plus there is the fact that a bi-partisan senate vote approved getting rid of them 59-40 and the only reason it wasn't removed sooner is Pelosi didn't want to bring it to the floor for a vote. Since she knew it would pass her legislative body.
Frankly if the Biden admin was as outraged by this as they pretend to be then they could challenge this in the courts.
Sure but part of the problem is that when those mandates go away, there is usually a significant spike in cases a month and two months afterwards. We're a reactionary culture. We wait for **** to go South then we take measures to adjust accordingly. And we both know there's a good chance those mandates resurface in the fall and winter so what does it matter that we keep them on airplanes and public transit?
I heard a lot of people say that after Delta. Btw, all of these variants have shown to be increasingly more contagious, not less so. Sure, they are less virulent but there's going to be another large spike in cases at some point this calendar year where masks mandates are probably going back into play. I understand why they were lifted in other places but I don't see the harm in keeping them on flights and public transit.
