It was announced on Monday's Tony Stewart Sirius Satellite Radio show that Ryan Newman would run the #39 in 2009 and NOT the #4.

Probably because he has a history with the 39. Ran all those Nationwide races in the 39. Supersticous move.

I was hearing that Morgan-McClure wasn't too happy with NASCAR for giving Stewart-Haas the #4. He says that the #4 still belongs to his team even though they aren't running right now. He has said that he put a lot of years in with that # to get it where it is today and that he's not ready to give it up just yet. Lets not forget that Ernie Irvan and Sterling Marlin both won the Daytona 500 with that car # so I guess I can see his point.

From what I understand NASCAR owns all the numbers not the teams. NASCAR assigns the #'s to the teams. So RCR really dosen't really own the #3 but if a team has a certain history with a # like RCR with the #3 and like Yates with the #28(which he is now using again after he allowed Dale Jr. do use the #88) they have some say if someone gets to use it if they are not using it. So I guess with the history the #4 car has with Morgan-McClure that NASCAR decided not to assign the # 4 out just yet. I could be wrong but I think it's pretty much correct.

^^ pretty much, and form what I understand a owner/team can put a claim on a number if they were the last one to use it in an event
