Can you cheat the cap with Birds Rights?.


OK here is the situation.

You are over the cap and you have a player that earns 20 millions a year, he has an opt out clause.

You are like 5 millions over the Cap, so if he opts out you are 15 millions under the cap.

The player has been playing for you for a lot of years so you have birds rights.


You also have a young stud who expires and you have team option.

You dont Exercise team option but since you drafted him you hold Restricted FA rights to match and since he has been 3 years in the team you can use bird rights too.

He expires like 4 million so now you are 19 millions down the Cap.


Yet you have another player expiring, a veteran who makes like 12 Million and you would like to resing because its a very good fit on your system.



So basically you are in summer 09 and have like 30 millions of cap space and 3 players to resign, two of them will demand max Bucks.

So basically after resigning the three you would be over the cap and would only be able to sign other players with your Mle, Bye etc etc.


But here is the question.

What happens if in July 1 when the three contracts are " expired" you make a top dollar Offer to one of the biggest name out in the FA market?....


Can you still RESIGN them the other players on day 15th after the FA has already signed with you? with your bird rights? or is there some rule to avoid this scenario?.

The player would receive cost a cap hold of 150% his previous salary


You also have a young stud who expires and you have team option.

This would not work. To keep control of a restricted free agent, you must extend a qualifying offer to a player. If that player declines the QO, you must keep a "cap hold" free until that player is signed, which costs the max after the player's 3rd season, or 300% of the player's previous salary after his 4th season. The NBA made this for this exact reason.

At this point, you would still be paying the "cap holds" of these players. That is the reason the NBA created them. The rookie would take up 300% of his old contract, or 12 million, as a cap hold. The veterans would take up 150% of their previous price, or, in this scenario, 30 million and 18 million. So right there, you have 60 million being taken up in cap holds. Someone could probably explain this much better than me BTW, but cap holds are the rule used to stop this.
